Terms of service

§ 1 Scope, provider

(1) These General Terms and Conditions (T&C) apply to all orders placed via our online shop (“shop”). The provider and contractual partner is Seibel & Weis GbR, Ziegeleiweg 5, 57319 Bad Berleburg, Germany, represented by the partners Lukas Seibel, Julia Weis and Gabriel Weis (“we” or “us”).

(2) A consumer within the meaning of these T&C is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade or self-employed profession (§ 13 BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade or self-employed profession when concluding a legal transaction (§ 14 BGB).

(3) We do not accept deviating terms of the customer unless we expressly agree to their validity.

§ 2 Conclusion of contract

(1) The presentation of products in the shop does not constitute a legally binding offer but a non-binding invitation to order.

(2) You can add products to the cart and change or remove them at any time. During checkout you enter your details and choose the shipping and payment method. Before submitting the order you can check all information again and correct input errors by going back in the checkout or changing the entries directly. By clicking the order button at the end of the checkout you submit a binding offer to purchase the goods in the cart.

(3) Immediately after submitting the order you will receive an order confirmation by email. With this order confirmation we accept your offer; the purchase contract is thereby concluded.

(4) The languages available for concluding the contract are German and English.

§ 3 Storage of the contract text

We store the contract text and send you the order data with the order confirmation by email. You can view and print these T&C on this page at any time. If you have created a customer account, you can view your orders there.

§ 4 Prices and shipping costs

(1) All prices are final prices and include statutory VAT.

(2) Delivery within Germany is free of charge. Details can be found under Shipping & payment.

§ 5 Delivery

(1) We deliver within Germany only.

(2) Unless stated otherwise for the respective product, delivery takes 1–2 working days after dispatch. If payment is received by 2 pm on a working day (Saturdays by 12 noon), we usually dispatch the same day.

§ 6 Payment

The available payment methods are shown during checkout. If you pay via a payment service provider (e.g. PayPal), its terms of use also apply.

§ 7 Retention of title

The goods remain our property until paid in full.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. Details can be found in our cancellation policy. You can also declare your withdrawal using the withdrawal function on our website.

§ 9 Warranty

(1) The statutory warranty rights apply.

(2) For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. This does not apply to claims for damages, claims in the cases of § 445b BGB, or where a defect has been fraudulently concealed.

(3) Installing spare parts requires technical expertise. Damage that only arises from improper installation or handling does not constitute a defect of the goods delivered. Your statutory rights in the event of defects of the goods remain unaffected.

(4) A guarantee only exists if it is expressly stated for the respective product.

§ 10 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have given.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract at the time the contract was concluded. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.

(3) Otherwise, liability for slightly negligent breaches of duty is excluded.

§ 11 Batteries and electrical equipment

Information on the return and disposal of used batteries and waste electrical equipment can be found under Disposal information.

§ 12 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 13 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which they have their habitual residence.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office.

(3) This is a translation. In case of doubt, the German version applies.
